Overview
Welcome to Elysian Jewels.
This website is operated by Elysian Jewels Ltd., doing business as Elysian Jewels (“Elysian Jewels,” “we,” “us,” or “our”).
We are a Vancouver-based fine jewellery business specializing in engagement rings, wedding bands, custom-designed jewellery, and fine diamond jewellery featuring both natural and lab-grown diamonds.
These Terms of Service (“Terms”) govern your access to our website, www.elysianjewels.ca, and your use of our products and services, including online purchases, private consultations, bespoke commissions, and purchases arranged directly with our team.
By purchasing from Elysian Jewels or confirming an order after receiving these Terms, you acknowledge the applicable purchase conditions, subject to your rights under applicable law.
Please review these Terms carefully before placing an order.
Our Privacy Policy, Shipping Policy, and Return & Exchange Policy provide additional information about our services and form part of the applicable purchasing terms where referenced.
Nothing in these Terms limits or excludes consumer rights that cannot legally be waived.
SECTION 1 — GENERAL CONDITIONS
Elysian Jewels provides fine jewellery products and services through its website and appointment-based studio in Vancouver, British Columbia.
Customers may browse our collections, request consultations, inquire about diamonds, purchase available jewellery, and commission custom-designed pieces.
You agree to provide accurate information when communicating with us or placing an order.
We reserve the right to decline an order before acceptance where reasonably necessary, including circumstances involving product unavailability, suspected fraud, incorrect pricing, or requests we cannot reasonably fulfil.
We will communicate any such decision and refund payments collected for an order we do not accept.
SECTION 2 — WEBSITE USE AND ELIGIBILITY
By accessing our website, you agree to use it lawfully and in a manner that does not interfere with its security, performance, or availability.
Purchasers must be legally capable of entering into a binding purchase agreement in their jurisdiction.
You may not attempt to compromise our website, transmit malicious software, access restricted systems without authorization, or use our content for fraudulent or unlawful purposes.
We may restrict access where necessary to protect our customers, systems, or business operations.
SECTION 3 — PRODUCTS AND SERVICES
Elysian Jewels offers a selection of fine jewellery, including:
- Engagement rings and wedding bands
- Natural and lab-grown diamond jewellery
- Earrings, necklaces, bracelets, and other fine jewellery
- Made-to-order and bespoke jewellery
- Selected gemstone jewellery and personalized designs
Certain pieces are created individually following an order, even when a design appears in our online collection.
Product specifications, available metals, gemstone characteristics, sizes, and customization options are identified on the relevant product page, quotation, or order confirmation.
Availability may change before an order is accepted.
We may discontinue products or modify future offerings without affecting an already accepted order, except as agreed with the customer or permitted by law.
SECTION 4 — PRODUCT DESCRIPTIONS AND PHOTOGRAPHY
We make reasonable efforts to represent our jewellery accurately through photography, videos, descriptions, and product specifications.
However, differences in screen settings, lighting, photography, perspective, and magnification may affect the appearance of a piece.
Natural gemstones may feature individual characteristics, including variations in colour, inclusions, and internal structure.
Handcrafted jewellery may also exhibit minor differences in finishing, proportions, or other details compared with illustrations or digital renderings.
These variations do not permit us to substitute materially different specifications or provide an item that fails to meet the agreed description.
Customers are encouraged to review all specifications carefully and contact our team with questions before confirming their purchase.
SECTION 5 — PRICING, CURRENCY AND TAXES
Unless otherwise stated, prices displayed on our Canadian website are expressed in Canadian dollars (CAD).
Applicable taxes, including GST and PST where required, will be identified before purchase and reflected on the relevant invoice or order confirmation.
Any additional charges that can be determined in advance will be disclosed before the order is finalized. Where charges such as international customs duties cannot reasonably be determined in advance, their nature will be disclosed.
Prices may vary according to diamond selection, gemstone characteristics, metal type, jewellery design, ring size, customization, and market conditions.
We reserve the right to correct genuine pricing errors before accepting an order.
Once an order and its price have been confirmed, the agreed price will not be changed without the customer's consent or another lawful basis.
Any additional costs arising from customer-requested modifications will be disclosed and agreed upon before the modifications proceed.
SECTION 6 — ORDER PLACEMENT AND CONFIRMATION
Orders may be initiated through our website, during a private consultation, or through direct communication with our team.
An order confirmation or sales agreement will identify the relevant purchase details, including the jewellery specifications, price, applicable taxes, payment arrangements, and agreed delivery or collection details.
A completed checkout or payment authorization does not necessarily constitute acceptance of an order if it remains subject to confirmation.
Once an order is accepted, the applicable agreement and mandatory consumer protection requirements govern its fulfilment.
Customers are responsible for reviewing the information provided before confirming their purchase, including:
- Diamond or gemstone specifications
- Metal type and colour
- Jewellery design and setting details
- Ring size or other dimensions
- Engraving or personalization
- Price and payment terms
- Delivery or collection arrangements
Please contact us promptly if you notice an error in your order information.
SECTION 7 — BESPOKE AND MADE-TO-ORDER JEWELLERY
Bespoke and made-to-order jewellery is produced specifically for the customer's selected design and specifications.
Our custom jewellery process may include consultation, diamond or gemstone selection, design development, CAD rendering, approval, manufacturing, finishing, and final quality inspection.
Before production, the agreed specifications will be confirmed with the customer as appropriate for the order.
For bespoke commissions, these may include the centre diamond, side stones, metal, ring dimensions, setting design, and other important design features.
A customer's approval of the final design and specifications authorizes Elysian Jewels to proceed with manufacturing.
Because bespoke jewellery involves individualized materials, design work, and manufacturing, confirmed bespoke orders are generally not eligible for voluntary cancellation, return, or exchange, except where otherwise agreed in writing or required by law.
If Elysian Jewels cannot supply the agreed diamond or manufacture the jewellery to the approved specifications, we will work with the customer to resolve the issue.
If we are unable to fulfil those specifications and no alternative is agreed upon, the customer will receive a full refund of the deposit and other payments made for the affected item.
SECTION 8 — CAD DESIGN AND CUSTOMER APPROVAL
For qualifying custom jewellery orders, Elysian Jewels may provide a computer-aided design (CAD) rendering, technical drawing, or other design representation for customer review.
CAD renderings are intended to communicate the proposed design, proportions, gemstone placement, and structural features before manufacturing.
Customers should carefully examine the proposed design and request necessary revisions before providing final approval.
Once the final design is approved and production begins, further modifications may not be possible.
Where modifications remain technically feasible, additional costs or manufacturing time may apply. These will be explained and agreed upon before proceeding.
CAD renderings may not reproduce every detail of the final polished jewellery, including exact reflections, lighting effects, microscopic surface details, or natural gemstone characteristics.
Nevertheless, the finished jewellery must conform to the agreed material specifications and approved design, allowing for reasonable handmade manufacturing tolerances.
SECTION 9 — DIAMOND SELECTION AND CERTIFICATION
Elysian Jewels offers both natural diamonds and lab-grown diamonds.
Diamond characteristics, including carat weight, colour, clarity, cut, shape, measurements, and certification, will be described in the applicable listing, quotation, or order documentation.
Where a particular diamond is sold with a grading report from the Gemological Institute of America (GIA), International Gemological Institute (IGI), or another identified grading laboratory, the corresponding report information will be provided as agreed.
For custom orders involving a specifically selected centre diamond, customers may review the relevant grading information and available diamond imagery before manufacturing.
Grading reports describe the characteristics of the examined diamond and are issued by independent laboratories. They do not constitute an insurance appraisal or guarantee of future market value.
Certification is not automatically included for every small accent diamond or gemstone unless expressly stated.
A material substitution affecting an agreed diamond's identity or specifications will require customer approval.
SECTION 10 — DEPOSITS AND PAYMENT TERMS
Custom jewellery orders generally require a deposit of 30% of the agreed purchase price unless different arrangements are confirmed in writing.
The exact deposit amount, outstanding balance, taxes, and payment schedule will be stated in the customer's quotation, invoice, or sales agreement.
A deposit allows Elysian Jewels to reserve or source materials and begin the agreed custom-order process.
After an order has been confirmed, customer-requested cancellation may result in the deposit being non-refundable under the agreed bespoke-order policy, except where required by law or otherwise expressly agreed.
If Elysian Jewels is unable to fulfil the approved specifications and no suitable alternative is agreed upon, all payments made for the affected item will be refunded.
The outstanding balance must be paid according to the agreed payment schedule, ordinarily before final delivery or collection.
Elysian Jewels accepts the payment methods identified at checkout or expressly confirmed by our team.
SECTION 11 — ORDER CHANGES AND CANCELLATIONS
Customers wishing to change or cancel an order should contact us as soon as possible.
Requests will be reviewed according to the type of jewellery, the applicable order agreement, the stage of production, and legal requirements.
For bespoke orders, changes requested after design approval may involve additional costs, revised specifications, and an updated delivery date.
For ready-to-wear or listed jewellery, cancellation and return eligibility will follow our published Return & Exchange Policy.
Elysian Jewels will not make a material change to an accepted order without appropriate agreement or another lawful basis.
Nothing in this section restricts cancellation, refund, or other remedies available under applicable consumer protection legislation.
SECTION 12 — RETURNS, EXCHANGES AND REFUNDS
Our Return & Exchange Policy explains the conditions applicable to different categories of jewellery.
Listed jewellery
For qualifying orders delivered within Canada or the United States, customers may request a return or exchange within seven days of delivery, subject to the conditions of our Return & Exchange Policy.
Items must meet the applicable eligibility and condition requirements, including being unworn and unaltered, with the required original packaging, documentation, and certificates.
For eligible voluntary returns of listed jewellery, a workmanship fee equal to 25% of the order value is deducted from the refund, subject to applicable law.
Approved refunds are processed to the original method of payment after the returned item has been received and assessed.
Bespoke and personalized jewellery
Custom-designed, bespoke, engraved, and specially personalized jewellery is generally considered final sale after order confirmation, unless otherwise agreed or required by law.
Other final-sale categories
Orders delivered outside Canada and the United States, and orders financed through installment services where offered, are subject to the final-sale conditions disclosed in our Return & Exchange Policy, except where applicable law requires otherwise.
Incorrect, defective, or non-conforming products
If an item is damaged on arrival, materially differs from the agreed specifications, or may have a manufacturing defect, please contact our team promptly.
Such issues will be reviewed independently of our voluntary change-of-mind return policy.
Statutory remedies and cancellation rights always take precedence over conflicting return restrictions or deductions.
Our full policy is available at:
www.elysianjewels.ca/exchange-policy
SECTION 13 — SHIPPING AND DELIVERY
Elysian Jewels provides complimentary, insured shipping as described in our Shipping Policy.
Our published standard fulfilment estimates are generally:
- Within Canada: 10–12 business days
- International orders: 14–18 business days
Different manufacturing or fulfilment schedules may apply to bespoke jewellery, specialized designs, or other orders requiring additional production time.
The applicable supply or delivery arrangements, including the agreed supply date, will be confirmed for each order where required.
Once an order is dispatched, tracking details will be provided when available.
For security purposes, delivery may require a signature or other identity verification.
International customers may be responsible for applicable import duties, customs assessments, taxes, or brokerage charges not included in the purchase price, as disclosed before purchase.
Delays may occasionally occur due to production requirements, shipping disruptions, customs clearance, or circumstances outside our reasonable control.
We will communicate material delays and discuss available arrangements with affected customers.
Your legal rights concerning delayed or undelivered goods remain unaffected.
Our full policy is available at:
www.elysianjewels.ca/shipping-policy
SECTION 14 — IN-STUDIO COLLECTION
Customers collecting jewellery from our Vancouver studio will be contacted when their order is ready, subject to the agreed arrangements.
Collection is ordinarily arranged by appointment.
Any outstanding payment must be completed before the jewellery is released, unless otherwise agreed.
We encourage customers to examine their completed jewellery at collection and raise any immediate concerns regarding visible condition or conformity with the approved specifications.
Once an item has been collected, the applicable return, warranty, and aftercare policies continue to govern that purchase.
Collection does not waive any non-excludable rights relating to undiscovered defects or failure to meet agreed specifications.
SECTION 15 — MANUFACTURING WARRANTY
Elysian Jewels provides a one-year manufacturing warranty on eligible jewellery, beginning from the date of delivery or collection.
This warranty covers manufacturing defects attributable to workmanship, subject to an assessment of the jewellery and the circumstances of the issue.
The warranty does not ordinarily cover damage caused by:
- Accidental impact, bending, or crushing
- Improper handling or misuse
- Ordinary wear and tear
- Loss, theft, or disappearance of the jewellery
- Exposure to damaging chemicals or unsuitable conditions
- Repairs or modifications by third parties that cause or contribute to the reported issue
Normal wear of metal surfaces, prongs, and settings may require periodic maintenance.
If you believe your jewellery has a manufacturing defect, please contact us with your purchase details and a description of the issue.
We will assess the piece and advise on the appropriate remedy.
This limited manufacturing warranty is additional to, and does not replace, rights and remedies provided by applicable law.
SECTION 16 — COMPLIMENTARY RESIZING AND AFTERCARE
Elysian Jewels offers complimentary aftercare services for eligible jewellery, including:
- One complimentary ring resizing within one year of purchase
- One professional cleaning and polishing service within one year
- One prong-tightening and jewellery-inspection service within one year
The precise service eligibility for a piece may depend on its design, construction, metal, and gemstone setting.
Certain jewellery designs, including some eternity bands or highly specialized settings, may not be safely resizable.
Where a requested size alteration is not technically feasible, our team will explain the available options before any work is undertaken.
Our separate Return & Exchange Policy also provides a 30-day complimentary ring-size exchange request window for eligible purchases.
Additional services or repairs outside the complimentary aftercare arrangements may incur charges, which will be disclosed before work begins.
Customers are encouraged to arrange periodic professional inspections to help maintain the security and condition of their jewellery.
SECTION 17 — JEWELLERY CARE AND INSURANCE
Fine jewellery requires appropriate care to preserve its appearance, structural integrity, and longevity.
We recommend removing jewellery during strenuous physical activity, swimming, heavy lifting, and exposure to harsh chemicals.
Jewellery should be stored securely and separately where practical to reduce scratches and accidental damage.
Customers should discontinue wearing an item if they notice a loose gemstone, damaged prong, bent setting, or other structural concern, and contact our team for inspection.
For valuable jewellery, we recommend considering independent jewellery insurance that addresses accidental loss, theft, and damage.
Elysian Jewels' manufacturing warranty does not replace a customer's personal jewellery insurance coverage.
SECTION 18 — PAYMENT SECURITY AND CUSTOMER INFORMATION
Customers agree to provide accurate billing, contact, and delivery information.
Payment transactions may be processed through independent payment service providers using their own secure payment systems.
We do not require customers to disclose complete payment-card credentials through ordinary email or social-media messages.
We may request additional verification where reasonably necessary to prevent payment fraud or unauthorized transactions.
Personal information collected during consultations, orders, and website use is handled in accordance with our Privacy Policy and applicable privacy laws.
Our Privacy Policy is available at:
www.elysianjewels.ca/privacy
SECTION 19 — INTELLECTUAL PROPERTY AND DESIGN MATERIALS
The contents of our website, including photographs, videos, text, branding, artwork, and original design materials, are owned by or licensed to Elysian Jewels and are protected by applicable intellectual property laws.
These materials may not be reproduced, distributed, commercially exploited, or used without appropriate authorization, except as permitted by law.
CAD drawings, renderings, and other design materials created by Elysian Jewels remain our intellectual property unless different ownership terms are expressly agreed in writing.
Purchasing a finished jewellery piece does not automatically transfer copyright or other intellectual property rights in its underlying drawings or creative materials.
Customers who provide reference photographs or design materials confirm that they have the right to provide them for the requested design work.
Elysian Jewels may use customer-provided materials for the purpose of developing and fulfilling the customer's order.
We will not publicly publish identifiable customer correspondence or personal design submissions for promotional purposes without an appropriate basis or permission.
SECTION 20 — THIRD-PARTY SERVICES AND EXTERNAL LINKS
Our website may contain links to independent websites or use third-party services for payment processing, scheduling, analytics, shipping, or other business functions.
These third parties may operate under separate terms and privacy policies.
Elysian Jewels is not responsible for independently operated third-party websites or services outside our control, except to the extent responsibility cannot legally be excluded.
We encourage customers to review relevant third-party terms when using those services.
SECTION 21 — WEBSITE AVAILABILITY AND LIMITATION OF LIABILITY
We make reasonable efforts to maintain accurate website information and reliable access to our online services.
However, the website may occasionally experience technical interruptions, maintenance, or temporary inaccuracies.
To the extent permitted by law, Elysian Jewels does not guarantee uninterrupted website availability and is not responsible for indirect losses arising solely from interruptions or unauthorized misuse of the website outside our reasonable control.
Nothing in these Terms excludes liability for fraud, intentional misconduct, or other liability that cannot lawfully be excluded.
Nothing in this section reduces our obligation to supply jewellery that conforms to the accepted agreement or restricts any applicable statutory warranty, refund, cancellation, or consumer remedy.
SECTION 22 — UNFORESEEN CIRCUMSTANCES AND DELAYS
Certain circumstances beyond our reasonable control may affect manufacturing or fulfilment, including severe weather, transportation interruptions, customs delays, labour disruptions, or significant supplier disruptions.
Where such circumstances materially affect an accepted order, Elysian Jewels will make reasonable efforts to notify the customer, provide updated information, and discuss an appropriate resolution.
Any adjustments to agreed delivery dates or material order specifications will be handled in accordance with the customer's agreement and applicable law.
This section does not remove any statutory right to cancel an eligible order or obtain a refund.
SECTION 23 — GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the applicable laws of British Columbia and the federal laws of Canada.
If a customer has a concern regarding an order, design, payment, or service, we encourage them to contact Elysian Jewels so the matter can be reviewed and an appropriate resolution explored.
Nothing in these Terms requires customers to submit disputes to mandatory arbitration or another compulsory dispute resolution process.
Nothing in these Terms prevents customers from exercising rights to bring lawful legal proceedings, participate in a class proceeding, communicate a review, or seek assistance from a consumer protection authority.
Customers retain all rights available under applicable consumer protection laws.
SECTION 24 — CHANGES TO THESE TERMS
Elysian Jewels may update these Terms to reflect changes to our operations, website, services, or legal obligations.
The version published at the time of a purchase or otherwise incorporated into the accepted order will generally govern that transaction, together with the applicable order-specific agreement and mandatory law.
Later changes will not retroactively alter material customer purchase obligations or remove accrued rights without a lawful basis.
The current published version of these Terms will be available on our website.
If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.
