Privacy Policy

Elysian Jewels Ltd. | Vancouver, British Columbia, Canada

Effective Date: 3 July 2024

Our Commitment to Your Privacy

At Elysian Jewels, we believe that trust is essential to every meaningful jewellery purchase. Whether you are exploring our collections, commissioning a bespoke engagement ring, or visiting our private studio, we are committed to respecting your privacy and protecting the personal information you share with us.

This Privacy Policy explains how Elysian Jewels Ltd., operating as Elysian Jewels (“Elysian Jewels,” “we,” “us,” or “our”), collects, uses, stores, discloses, and safeguards personal information.

The policy applies to our website, www.elysianjewels.ca, as well as enquiries, appointment bookings, purchases, custom jewellery consultations, and other interactions with our business.

We handle personal information in accordance with applicable Canadian privacy legislation, including British Columbia's Personal Information Protection Act (PIPA) and the federal Personal Information Protection and Electronic Documents Act (PIPEDA), where applicable.

We aim to collect only the information reasonably necessary to provide our products and services, maintain secure operations, and fulfil our legal obligations.

1. Personal Information We Collect

The information we collect depends on how you interact with Elysian Jewels. It may include:

  • Contact and delivery details: your name, email address, telephone number, billing address and shipping address.
  • Purchase and service records: order history, invoices, deposits, payment status, transaction references, delivery arrangements, returns and warranty enquiries.
  • Jewellery and design information: ring sizes, diamond and gemstone preferences, metal choices, approved specifications, CAD approvals, engraving instructions and design references you choose to provide.
  • Appointment information: your selected date and time, consultation type, preferences, referral source, correspondence and uploaded reference images.
  • Payment information handled by our authorized payment provider, together with the transaction and customer details needed to confirm and fulfil your purchase.
  • Technical and usage information: IP addresses used in online connections, browser and device characteristics, referral sources, approximate location and page interactions, as applicable to website operation and analytics.

Our website uses Stripe-hosted checkout to collect payment details. We do not intentionally store complete payment-card numbers or card security codes in our own website database. Our order records contain information such as payment status, transaction references, customer contact details and billing or shipping addresses.

Please do not include payment-card numbers, card security codes or unrelated sensitive personal information in enquiry forms, reference images, ordinary emails or social media messages.

2. How We Collect Your Information

We collect information that you provide through website enquiry forms, bespoke design requests, appointment bookings, emails, telephone calls, official social media messages, consultations, purchases and after-sales services.

Our website and service providers also process technical information through essential website technologies, browser storage, cookies and analytics. Payment processors and delivery providers may supply transaction, payment-status or delivery information needed to manage your order.

We also display publicly available Google reviews, including reviewer names, ratings, comments and publication information supplied by Google.

We collect personal information for identified, reasonable purposes, with the consent required in the circumstances or another basis permitted by applicable law. You may ask our team why particular information is requested.

3. How We Use Your Personal Information

We use relevant personal information to:

  • Respond to enquiries, discuss jewellery options and prepare quotations.
  • Arrange appointments and communicate consultation details.
  • Process transactions, record deposits and payments, and fulfil orders.
  • Develop CAD designs, obtain approvals, manufacture jewellery and arrange delivery or collection.
  • Provide cleaning, resizing, inspections, warranty assistance and other agreed aftercare.
  • Maintain financial, tax and accounting records and meet legal obligations.
  • Help prevent fraud, address misuse and maintain website security.
  • Understand website performance and improve the browsing experience.
  • Send optional promotional communications only when legally authorized.

If we propose a materially different use, we will provide appropriate notice and obtain additional consent where required. We do not treat information provided for one purpose as unrestricted permission to use it for unrelated purposes.

4. Consent and Your Choices

Consent may be express or implied, depending on the nature and sensitivity of the information, the circumstances and applicable law. We seek meaningful consent where required and aim to explain the purpose of collection clearly.

Providing your contact details to book an appointment or ask about a piece does not automatically consent to unrelated promotional messages. Appointment confirmations, design discussions, payment notices, delivery updates and service responses are distinct from optional marketing.

You may withdraw consent for a particular use or disclosure by contacting info@elysianjewels.ca, subject to reasonable notice and applicable legal or contractual restrictions. We will explain any consequences, including where information is necessary to complete an order or provide a requested service.

Withdrawing consent does not necessarily require deletion of information that must be retained for legal, accounting or other permitted purposes.

5. Website Analytics and Cookies

Essential website technologies

We use technologies needed to operate the website and support functions such as shopping-cart storage, checkout and security. The shopping cart uses browser local storage to retain selected pieces and their configuration, including any personalization you enter. Payment and hosting providers may use their own essential technologies when providing their services.

Website fonts are loaded from Google Fonts. Requests for fonts and other externally hosted resources may disclose technical connection information, such as an IP address and browser information, to the provider serving that resource.

Google Analytics 4

Our public website uses Google Analytics 4 (GA4) to understand visits and website performance. It may process page visits, referral sources, browser and device characteristics, approximate locations, website interactions and cookie or similar identifiers. Technical connection information may be used by Google to provide its service and derive approximate location.

We do not configure Analytics to receive information entered in our appointment, enquiry or checkout fields, payment-card details, or uploaded design images. Please avoid placing personal information in page URLs or other publicly visible website interactions.

Learn more through Google’s Privacy Policy and the Google Analytics opt-out browser add-on. The add-on affects Google Analytics measurement; it does not disable every technology used by a website.

Advertising and measurement technologies

With your advertising consent, we use Meta Pixel to measure page visits, product views, successful additions to your cart, checkout starts and confirmed purchases. Meta may receive page URLs, product identifiers, purchase value and currency, browser and device information, IP addresses and cookie identifiers for advertising measurement and relevance. We do not send contact-form contents, design notes, uploaded images, payment-card details or private checkout references through these events. The Meta script and events are blocked until you allow advertising cookies. We have not implemented a separate Google Ads conversion tag.

Managing cookies and browser storage

You can use your browser settings to block or delete cookies and clear local storage. Doing so may remove your shopping-cart selections or affect some website or payment functions. You can accept or reject optional Meta advertising cookies using our privacy-choice banner, and change that choice through Privacy preferences in the footer. Rejecting these cookies does not prevent shopping or checkout. These advertising preferences apply to Meta; Google Analytics controls remain available through your browser and Google’s opt-out tools.

Browser settings do not necessarily prevent every form of technical processing. Contact our privacy representative if you need more information about the website’s technologies.

6. Marketing Emails and Communications

Any promotional emails or other commercial electronic messages we send must be authorized under Canada’s Anti-Spam Legislation (CASL) and other applicable laws. We do not treat an appointment booking or design enquiry as blanket permission for marketing.

You may withdraw marketing consent using the unsubscribe option included in a promotional message or by emailing info@elysianjewels.ca. We will handle requests in accordance with applicable requirements.

Unsubscribing from promotional messages does not prevent necessary communications about an existing enquiry, appointment, order, payment, delivery, warranty issue or privacy request. Our current website does not include a newsletter subscription form.

7. How We Share Personal Information

We may disclose relevant information to authorized providers or recipients where reasonably necessary for the purpose involved, with consent or another lawful basis. These may include:

  • Payment processors, including Stripe for website checkout, and financial institutions involved in your payment.
  • Jewellers, CAD designers and production partners who need the agreed technical specifications to make or service your piece.
  • Shipping companies and insured couriers arranging delivery or approved returns.
  • Website hosting, database, cloud image storage, analytics and other technology providers.
  • Calendar and communication providers supporting appointments, confirmations and order messages.
  • Accountants, legal advisers and public authorities where disclosure is appropriately authorized, permitted or required.

Website enquiries and bookings are handled by our Elysian service system. Uploaded reference images are stored using Cloudinary, and image links may be included in messages to our team. Where our Google Calendar connection is enabled, booking details—including contact information, consultation preferences, notes and reference-image links—may be included in a calendar event and customer invitation.

Elysian Jewels does not sell customer contact lists to data brokers. Service providers should receive only the information reasonably necessary for their responsibilities. Our approach is to select providers and use appropriate contractual or other safeguards for information handled on our behalf.

8. Privacy of Custom Jewellery Designs and Consultations

Bespoke jewellery can involve personal stories, proposal plans and meaningful references. We use the engagement ring preferences, specifications, reference photographs, CAD designs, approvals and correspondence you provide to understand and fulfil your project.

Relevant technical details may be shared with jewellers, CAD designers and production partners. Personal details that are unnecessary for production should not be included in those instructions.

We will not publish identifiable customer stories, private correspondence, photographs, testimonials or consultation materials for marketing without an appropriate legal basis or permission. Sharing a design reference with our team is not unrestricted permission to publish it.

Please share only references you are entitled to provide and avoid unnecessary sensitive information in photographs or notes. Reference-image links used for enquiries or bookings should not be treated as a secure document-sharing channel.

9. Data Storage and International Processing

Elysian Jewels is based in Vancouver, British Columbia. Our technology and service providers may process or store information in Canada, the United States or other countries. We do not represent that all customer information is stored exclusively in Canada.

Information processed outside Canada may be subject to the laws of the country concerned, including lawful access requirements. Provider locations and processing arrangements may vary according to the service and its configuration.

Our approach is to use reasonable safeguards for information entrusted to service providers, including limiting the information shared and considering the provider’s privacy and security arrangements. Contact us if you have questions about processing locations relevant to your information.

10. Data Retention

We aim to retain personal information only for as long as reasonably necessary for the identified purpose or an applicable legal requirement. The appropriate period depends on the record and the circumstances.

Order and invoice records may need to be retained for tax, accounting, transaction and dispute purposes. Approved jewellery specifications, CAD and manufacturing records, and warranty or aftercare records may be needed to fulfil the order and support later service. Appointment enquiries and correspondence are retained according to their continuing business purpose and any applicable obligations.

When information is no longer required, our approach is to arrange secure deletion, destruction or anonymization, as appropriate to the record and storage system. Some information may remain in backups until those backups expire under the relevant arrangements, or be retained where law or a legitimate unresolved matter requires it.

No single retention period applies to every category of information. You may contact us about a specific record or request deletion where legally available; we will explain any reason it must be retained.

11. Security of Personal Information

We take reasonable steps to protect personal information against unauthorized access, loss, misuse and disclosure. Our safeguarding approach includes limiting access to people who need the information, protecting administrative access, using secure payment-provider arrangements, and applying appropriate administrative, technical and physical measures.

Website payments are entered through Stripe-hosted checkout rather than an ordinary enquiry form. Please do not send payment-card credentials by email or social media. Staff and service partners should handle customer information only for authorized responsibilities.

No website, transmission method or storage system can be guaranteed completely secure. We do not promise absolute security or claim a particular security certification for Elysian Jewels.

If we become aware of a privacy incident, we will assess the circumstances, take appropriate steps to contain and address it, and notify affected individuals or relevant authorities where required by applicable law.

12. Your Privacy Rights

Depending on the applicable law and circumstances, you may:

  • Request access to personal information we hold about you and information about its use or disclosure.
  • Ask us to correct inaccurate or incomplete personal information.
  • Withdraw consent for a use or disclosure where permitted.
  • Request deletion where legally available, subject to retention requirements and other lawful exceptions.
  • Unsubscribe from optional marketing communications.
  • Ask questions or make a complaint about our handling of personal information.

Send requests to info@elysianjewels.ca with the subject line “Privacy Request.” Include enough information to identify the relevant interaction or order, but do not send unnecessary sensitive documents.

We may need to verify your identity or authority before releasing or changing information. We will respond according to applicable requirements and explain any lawful limitations, including restrictions that protect another person’s information.

13. Children’s Privacy

Our website and jewellery purchasing services are intended primarily for adults. We do not knowingly seek to collect children’s personal information for marketing purposes.

Where an interaction involves a child’s personal information, we will seek parental or guardian consent when required by law and limit collection to an appropriate purpose.

If you believe a child’s information has been provided inappropriately, contact info@elysianjewels.ca. We will review the circumstances and take appropriate steps, which may include deletion where legally permitted.

14. Third-Party Websites and Social Media

Links to external websites, social media platforms and independent booking or payment services may take you to services with their own privacy policies. Their policies govern information they collect for their own purposes.

Please review those policies before providing personal information. Sending us a message through social media may also make that message available to the platform according to its practices.

Using a service provider does not remove our responsibilities for information entrusted to that provider on our behalf under applicable law.

15. Changes to This Privacy Policy

We may update this policy as our business operations, technology or legal requirements change. The current version will remain accessible at elysianjewels.ca/privacy.

Material changes affecting the handling of personal information will be accompanied by appropriate notice and additional consent where required. An update does not automatically authorize a materially different use of previously collected information.

The effective date is displayed at the beginning of this policy using the same date arrangement as our Terms of Service. If a later version is introduced, its date and any necessary notice will be provided.

16. Privacy Questions and Complaints

Please contact our designated privacy representative at info@elysianjewels.ca if you have concerns about how information has been collected, used, disclosed or protected. Use the subject line “Privacy Request” or “Privacy Complaint” and describe the issue and the response you are seeking.

We will review your concern and respond in accordance with applicable law. You may also contact the Office of the Information and Privacy Commissioner for British Columbia at Office of the Information and Privacy Commissioner for British Columbia for information about your rights, access requests and privacy complaints.

You do not need to give up a legal right or remedy to raise a concern with our team. Where federal privacy law applies, the Office of the Privacy Commissioner of Canada may also be a relevant authority.
